最高人民检察院关于受理行贿犯罪档案查询的暂行规定的公告

为规范行贿犯罪档案查询工作，最高人民检察院制定了《关于受理行贿犯罪档案查询的暂行规定》，现予公布，自即日起施行。 最高人民检察院 二○○六年三月四日 最高人民检察院关于受理行贿犯罪档案查询的暂行规定 　　第一条　为了充分发挥检察机关法律监督职能作用，遏制和防范职务犯罪，促进社会信用体系建设，打击商业贿赂违法犯罪行为，服务社会主义市场经济，决定建立行贿犯罪档案系统，并对外受理查询。 　　第二条　行贿犯罪档案目前录入的范围为：1997年刑法修订实施以来，由检察机关立案侦查、并经人民法院裁判的发生在建设、金融、医药卫生、教育和政府采购领域的个人行贿、单位行贿、对单位行贿、介绍贿赂犯罪案件的档案。 　　第三条　检察机关对外受理行贿犯罪档案查询工作，由检察机关预防职务犯罪部门负责承办。 　　第四条　向检察机关提出查询申请时，单位应当出具书面申请和单位证明，个人应当出具书面申请和有效身份证件。 　　第五条　检察机关应当对受理的查询申请进行审查。对符合条件的，应当在受理后三日内书面告知查询结果；对不符合条件的，应当及时告知对方并说明原因。 　　第六条　检察机关对有行贿犯罪记录的单位或者个人，应当向申请查询的单位或者个人提供以下内容： （一）行贿犯罪行为实施的时间和犯罪数额； （二）判决的时间和结果； （三）共同实施行贿犯罪中的被查询对象的相关内容。 第七条　有关单位或者个人对检察机关提供的查询结果有异议的，可以向提供查询的检察机关请求复核。受理复核的检察机关应当在三日内反馈复核结果。 　　第八条　检察机关不干预、不参与有关单位或者个人对查询结果的处置。 　　第九条　检察机关开展行贿犯罪档案查询工作接受社会监督。
